Terms & Condition

These General Terms and Conditions (hereinafter referred to as “Terms”) form the basis for the provision of services by Desert Diamond Car Detailing L.L.C (hereinafter referred to as “DDD”) to the Customer. By engaging in the services provided by DDD, the Customer agrees to be bound by the Terms outlined herein.

تشكل هذه الشروط والأحكام العامة (المشار إليها فيما يلي باسم “الشروط”) الأساس لتقديم الخدمات من قبل شركة Desert Diamond Car Detailing L.L.C (المشار إليها فيما يلي باسم “DDD”) للعميل. من خلال الاشتراك في الخدمات التي تقدمها DDD، يوافق العميل على الالتزام بالشروط الموضحة هنا.

1. The Customer agrees not to leave any personal belongings in their vehicles, including items such as sunglasses, key chains, lighters, money, etc. The Customer confirms that there are no illegal items in the vehicle. DDD assumes no liability for any loss or damage to personal property, including the vehicle being serviced, any items contained in the vehicle, or at the location of the Service. The Customer undertakes to supply a backup set of keys in case the vehicle unexpectedly closes while the keys are inside.

1. موافقة العميل على عدم ترك ممتلكات شخصية داخل المركبة،

تتضمن متعلقات مثل نظارات شمسية ، علاقة مفاتيح، ولاعات، نقود، الخ.

موافقة العميل عدم وجود أي مواد غير قانونية داخل المركبة.

شركة ديزرت دايموند(DDD) غير مسؤولة عن أي فقدان او ضرر لأي ممتلكات شخصية داخل المركبة المراد صيانتها او في موقع الصيانة.

يتعين على العميل تقديم مفاتيح اضافية للمركبة في حال قفل المركبة بشكل مفاجئ في وقت الصيانة.

2. By signing a Service order, the Customer agrees to pay for all Services listed therein and, if applicable, other additional Services according to the Invoice.

2. من خلال التوقيع على طلب الخدمة، يوافق العميل على الدفع مقابل جميع الخدمات المدرجة فيه، وإذا أمكن، الخدمات الإضافية الأخرى وفقًا للفاتورة.

3. All initial prices given by DDD to the Customer shall constitute an estimate and not a quotation. Estimates are given subject to the Customer’s acceptance that costs may fluctuate in accordance with the actual costs of materials/parts provided and Services rendered.

a. Unless the parties agreed that no additional Services will be rendered or materials/parts provided without the Customer’s express consent, DDD shall be entitled to render such additional Services and provide such additional materials/parts as may reasonably be required, the reasonable costs whereof the Customer undertakes to pay.

b. The Customer is entitled to receive estimates from DDD and by choosing not to receive an estimate does so at its own risk and agrees to pay DDD the reasonable costs for the Services and/or materials/parts. If requested, an estimate for additional Services might be given by DDD orally by phone or via text message services at DDD’s full and sole discretion. Any additional services approved by the Customer verbally or via SMS shall form part of the Services and shall be subject to all terms and conditions contained herein.

c. Should any dispute exist as to what would constitute the reasonable costs under the circumstances, the Customer will pay such costs pending resolution of the dispute and will not be relieved from accumulating storage costs pending resolution of such dispute.

 3. كافة الأسعار المقدمة من شركة ديزرت دايموند(DDD) هي تقديرية ولا تعتبر عرض سعر.

يتم تقديم التقديرات بشرط قبول العميل بأن التكاليف قد تتغير وفقًا للتكاليف الفعلية للمواد/الأجزاء المقدمة والخدمات المقدمة.

أ. ما لم يتفق الطرفان على عدم تقديم أي خدمات إضافية أو توفير مواد/أجزاء دون موافقة صريحة من العميل، يحق لشركة ديزرت دايموند(DDD) تقديم هذه الخدمات الإضافية وتوفير المواد/الأجزاء الإضافية التي قد تكون مطلوبة بشكل معقول، مع تحمل التكاليف المعقولة للعميل يتعهد بالدفع.

ب. يحق للعميل الحصول على تقديرات من شركة ديزرت دايموند(DDD) وباختيار عدم تلقي تقدير، فإنه يفعل ذلك على مسؤوليته الخاصة ويوافق على دفع شركة ديزرت دايموند(DDD) التكاليف المعقولة للخدمات و/أو المواد/الأجزاء. إذا طلب ذلك، قد يتم تقديم تقدير للخدمات الإضافية بواسطة شركة ديزرت دايموند(DDD) شفهيًا عبر الهاتف أو عبر خدمات الرسائل النصية وفقًا لتقدير شركة ديزرت دايموند(DDD) الكامل والوحيد. تشكل أي خدمات إضافية يوافق عليها العميل شفهيًا أو عبر الرسائل النصية القصيرة جزءًا من الخدمات وتخضع لجميع الشروط والأحكام الواردة في هذه الوثيقة.

ج. في حالة وجود أي نزاع حول ما يمكن أن يشكل تكاليف معقولة في ظل هذه الظروف، سيدفع العميل هذه التكاليف في انتظار حل النزاع ولن يتم إعفاؤه من تراكم تكاليف التخزين في انتظار حل هذا النزاع.

4. Service times are estimates only as every vehicle is different and service may take more or less time. No compensation can be claimed for any delay in Service.

5. All vehicles are cleaned at the Customer’s own risk and must withstand the usual cleaning processes. Any claims for damages arising from the cleaning are limited to the cost of the Service. DDD assumes no liability if the windshield has a preexisting crack, and it becomes larger.

6. The delivery of the vehicle to DDD is carried out with an external and internal inspection of the vehicle, without checking the condition of the interior, including electrical systems. The Customer waives any claim/demand against DDD regarding the internal systems, including electrical systems.

7. DDD may assign any employee or a third party to service the vehicle and may change them at its sole discretion without notice or penalty. The Customer authorizes DDD to lift, transport the vehicle from one place to another or transfer to and/or from any third party as may reasonably be required or necessary, including for purposes of testing, diagnostics and Services. Any such lifting, transportation or transfer is undertaken strictly subject to it being done at the Customer’s risk and under waiver of any/all claims against DDD arising therefrom.

7. يجوز لشركة ديزرت دايموند(DDD) تعيين أي موظف أو طرف ثالث لخدمة السيارة ويجوز لها تغييرهم وفقًا لتقديرها الخاص دون إشعار أو عقوبة. يأذن العميل لشركة ديزرت دايموند(DDD) برفع السيارة أو نقلها من مكان إلى آخر أو نقلها إلى و/أو من أي طرف ثالث حسب ما قد يكون مطلوبًا أو ضروريًا بشكل معقول، بما في ذلك لأغراض الاختبار والتشخيص والخدمات. أي مثل رفع أو مواصلات أو نقل من هذا القبيل بشكل صارم على أن يتم ذلك على مسؤولية العميل وبموجب التنازل عن أي/جميع المطالبات ضد ديزرت دايموند(DDD) الناشئة عن ذلك.

8. Any claim for any loss or damage is subject to these terms and conditions and to DDD’s then current insurance policy.

8 . تخضع أي مطالبة بالتعويض عن أي خسارة أو ضرر لهذه الشروط والأحكام ولبوليصة التأمين الحالية الخاصة بشركة ديزرت دايموند(DDD) .

9. Unless indicated otherwise in this clause 9, the Customer is required to make the payment for the Services upon collecting the vehicle after the Service. Any unpaid amount will result in DDD retaining the vehicle and only releasing it until full payment is made. The vehicle will remain with DDD at the Customer’s risk until late payment is received in full and the conditions of the clause 20 will apply to the unclaimed vehicle.

The Customer acknowledges hereby that according to DDD’s polices some of the Services, e,g. applying paint protection film, are subject to full non-refundable down payment.

9. ما لم تتم الإشارة إلى خلاف ذلك في هذا البند 9، يتعين على العميل سداد ثمن الخدمات عند استلام السيارة بعد الخدمة. سيؤدي أي مبلغ غير مدفوع إلى احتفاظ شركة ديزرت دايموند(DDD) بالسيارة والإفراج عنها فقط حين يتم سداد المبلغ بالكامل. ستبقى السيارة مع شركة ديزرت دايموند(DDD) على مسؤولية العميل حتى يتم استلام الدفعة المتأخرة بالكامل وسيتم تطبيق شروط البند 20 على السيارة التي لم تتم المطالبة بها.

يقر العميل بموجب هذا أنه وفقًا لسياسات شركة ديزرت دايموند(DDD) ، فإن بعض الخدمات، على سبيل المثال. تطبيق طبقة حماية الطلاء، تخضع لدفعة مقدمة كاملة غير قابلة للاسترداد.

10. The Customer consents to a lien in favor of DDD for any unpaid Services, storage costs and third-party costs.

11. DDD guarantees the quality of the Services provided and materials/parts for 2 days from the date of Services completion. The warranty obligation does not apply to the following services: restoration of the interior, reinforcement work for the installation and operation of non-original and used parts, spare parts, washing procedures for the engine compartment (engine compartment) and radiator.

11. تضمن شركة ديزرت دايموند(DDD) جودة الخدمات المقدمة والمواد/الأجزاء لمدة 2 يوم من تاريخ اكتمال الخدمات. لا ينطبق التزام الضمان على الخدمات التالية: ترميم المقصورة الداخلية، وأعمال التعزيز لتركيب وتشغيل الأجزاء غير الأصلية والمستعملة، وقطع الغيار، وإجراءات الغسيل لحجرة المحرك (حجرة المحرك) والرادياتير.

12. The following circumstances are not covered by warranty under the clause 11:

a. Breakage of the film due to mechanical action (stone chips, friction, accidents, etc.), due to high pressure equipment during washing operations, mechanical lifting of the edge of the film due to water pressure, lifting of the film due to previously carried out washing operations the expiration of 10 (ten) calendar days after the film installation; peeling, swelling of the vinyl film in the doorways of the vehicle, mechanical lifting of the polyurethane film when gluing decorative strips and other elements with a coating width of less than 5 cm, swelling, peeling of the film on previously painted elements; any defects in the film if the vehicle is not is made available for inspection within 14 calendar days after the Services completion.

b. Peeling off paint, varnish or substrate; when painting work was carried out on elements subjected to corrosion and/or repairs, work was carried out on elements subjected to high-temperature heating.

c. Damage to the glass heating elements and the paint or varnish coating of vehicle elements when dismantling the tint, protective or vinyl film; No warranty given will cover abuse, excessive or abnormal use, use contrary to any manufacturer’s specifications or normal wear and tear.

d. Fogging of headlights and lanterns.

12. لا يغطي الضمان الظروف التالية بموجب البند 11:

أ. كسر الفيلم بسبب عمل ميكانيكي (رقائق الحجر، الاحتكاك، الحوادث، إلخ)، بسبب معدات الضغط العالي أثناء عمليات الغسيل، الرفع الميكانيكي لحافة الفيلم بسبب ضغط الماء، رفع الفيلم بسبب حمله مسبقًا عمليات الغسيل الخارجية بعد انقضاء 10 (عشرة) أيام تقويمية بعد تركيب الفيلم؛ تقشير، تورم فيلم الفينيل في مداخل السيارة، الرفع الميكانيكي لفيلم البولي يوريثين عند لصق الشرائط الزخرفية والعناصر الأخرى التي يبلغ عرض طلاءها أقل من 5 سم، تورم، تقشير الفيلم على العناصر المطلية مسبقًا؛ أي عيوب في الفيلم إذا لم تكن السيارة متاحة للفحص خلال 14 يومًا تقويميًا بعد اكتمال الخدمات.

ب. تقشير الطلاء أو الورنيش أو الركيزة؛ عندما يتم تنفيذ أعمال الطلاء على العناصر المعرضة للتآكل و/أو الإصلاحات، يتم تنفيذ العمل على العناصر المعرضة لدرجات حرارة عالية.

ج. تلف عناصر تسخين الزجاج وطلاء الطلاء أو الورنيش لعناصر السيارة عند تفكيك الطبقة الملونة أو الواقية أو الفينيل؛ لن يغطي أي ضمان إساءة الاستخدام أو الاستخدام المفرط أو غير الطبيعي أو الاستخدام المخالف لمواصفات أي شركة مصنعة أو التآكل العادي.

د. تعفير المصابيح الأمامية والفوانيس.

13. If the Services are carried out using materials/parts provided by the Customer, DDD assumes no responsibility for the quality of the materials/parts or the Services.

13. إذا تم تنفيذ الخدمات باستخدام المواد/الأجزاء المقدمة من قبل العميل، فلا تتحمل شركة ديزرت دايموند(DDD) أي مسؤولية عن جودة المواد/الأجزاء أو الخدمات.

14. Unless before the start of Services the Customer expressly requests to have old disassembled parts and materials returned, those to be dismissed or used in any other way at DDD sole and full discretion.

14. ما لم يطلب العميل صراحةً، قبل بدء الخدمات، إعادة الأجزاء والمواد القديمة المفككة، فسيتم التخلص منها أو استخدامها بأي طريقة أخرى وفقًا لتقدير DDD الوحيد والكامل.

15. The Customer acknowledges hereby that as a result of the provision of certain Services, some characteristics of the vehicle may change, and the Customer fully bears the risk of possible adverse consequences of the operation of the vehicle, including loss of the right to warranty services for the vehicle, incurring additional costs associated with the maintenance and repair of the vehicle, possible loss of the right to insurance compensation under insurance contracts, refusal of registration by the regulatory authority (RTA), including deregister the vehicle and the vehicle administrative liability.

15. يقر العميل بموجب هذا أنه نتيجة لتقديم خدمات معينة، قد تتغير بعض خصائص السيارة، ويتحمل العميل بشكل كامل مخاطر العواقب السلبية المحتملة لتشغيل السيارة، بما في ذلك فقدان الحق في الضمان. خدمات للمركبة، وتكبد تكاليف إضافية مرتبطة بصيانة وإصلاح السيارة، واحتمال فقدان الحق في تعويض التأمين بموجب عقود التأمين، ورفض التسجيل من قبل الهيئة التنظيمية (RTA)، بما في ذلك إلغاء تسجيل السيارة والمسؤولية الإدارية للمركبة .

16. In any case, DDD’s liability arising from any warranty shall be limited to the reasonable costs of fixing or replacing defective Services or materials/parts.

17. The Customer acknowledges that by providing Customer’s personal data to DDD, its employees, agents or contractors, the Customer agrees that DDD may collect, use and disclose such personal data, for any lawful purposes in accordance with applicable law.

17. يقر العميل أنه من خلال تقديم بياناته الشخصية إلى شركة ديزرت دايموند(DDD) أو موظفيها أو وكلائها أو مقاوليها، يوافق العميل على أنه يجوز لشركة ديزرت دايموند(DDD) جمع هذه البيانات الشخصية واستخدامها والكشف عنها لأي أغراض مشروعة وفقًا للقانون المعمول به.

18. DDD will not be liable for any failure or delay in performing its obligation under due to any of the following causes (which causes are hereinafter referred to as “Force Majeure”), to the extent beyond its reasonable control: acts of God, accident, riots, war, terrorist act, epidemic, pandemic (including the Covid-19 pandemic), quarantine, civil commotion, breakdown of communication facilities, breakdown of web host, breakdown of internet service provider, natural catastrophes, governmental acts or omissions, changes in laws or regulations, national strikes, fire, explosion, or generalized lack of availability of raw materials or energy.

18. لن تكون شركة ديزرت دايموند(DDD) مسؤولة عن أي إخفاق أو تأخير في أداء التزامها بموجب أي من الأسباب التالية (والتي يشار إليها فيما بعد باسم “القوة القاهرة”)، إلى الحد الخارج عن سيطرتها المعقولة: القضاء والقدر، حادث، أعمال شغب، حرب، عمل إرهابي، وباء، وباء (بما في ذلك جائحة كوفيد-19)، الحجر الصحي، الاضطرابات المدنية، انهيار مرافق الاتصالات، انهيار مضيف الويب، انهيار مزود خدمة الإنترنت، الكوارث الطبيعية، الأفعال الحكومية أو الإغفالات، التغييرات في القوانين أو اللوائح، أو الإضرابات الوطنية، أو الحرائق، أو الانفجارات، أو النقص العام في توافر المواد الخام أو الطاقة.

19. The vehicle can only be delivered for the Services and/or picked up after the Services by a person other than the vehicle owner with the permission of the vehicle owner, the driver. DDD reserves the right to refuse acceptance and/or delivery in case of insufficient proof of authorization by the ownership.

20. The vehicle should be collected within 24 hours of completion of Services to avoid the parking fee of AED 100 per day. If the Customer does not pick up the vehicle within 24 hours after the completion of the Services, DDD might choose at its sole and full discretion to park the vehicle outside DDD’s premises. In any case, DDD assumes no liability to the unclaimed vehicle for (i) any damage caused by sun, rain, climate changes or other causes, (ii) fines, or (iii) parking fees.

20. يجب استلام السيارة خلال 24 ساعة من الانتهاء من الخدمات لتجنب رسوم ركن السيارة البالغة 100 درهم إماراتي في اليوم. إذا لم يستلم العميل السيارة في غضون 24 ساعة بعد الانتهاء من الخدمات، فقد تختار شركة ديزرت دايموند(DDD) وفقًا لتقديرها الوحيد والكامل إيقاف السيارة خارج مباني شركة ديزرت دايموند(DDD) في أي حال، لا تتحمل شركة ديزرت دايموند(DDD) أي مسؤولية تجاه السيارة التي لم يطالب بها أحد بسبب (1) أي ضرر ناتج عن الشمس أو المطر أو تغيرات المناخ أو أسباب أخرى، (2) الغرامات، أو (3) رسوم وقوف السيارات.

21. DDD requests all Customers to check their personal belongings and the condition of their vehicle prior to leaving the premises. Any complaint later will be disregarded.

21. تطلب DDD من جميع العملاء التحقق من متعلقاتهم الشخصية وحالة سيارتهم قبل مغادرة المبنى. سيتم تجاهل أي شكوى لاحقا.
